Cyber Scent Work, Inc. (“CSW”, “we” or “us” or “our”) respects the privacy of our users (“user” or “you”). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our application site, cyber-sw.com (the “Application Site”). Please read this Privacy Policy carefully. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT ACCESS THE APPLICATION SITE. BY USING ANY PART OF THE APPLICATION SITE AND/OR OUR SERVICES, YOU CONSENT TO THE COLLECTION, USE, AND DISCLOSURE OF YOUR INFORMATION AS FURTHER OUTLINED IN THIS PRIVACY POLICY.

This Privacy Policy does not apply to the third-party online service allowing you to make payments (i.e., PayPal and Stripe) or used in connection with our services (i.e., YouTube), which may also collect and use data about you. We are not responsible for any of the data collected by any such third party.

COLLECTION OF YOUR INFORMATION

We may collect information about you in a variety of ways. The information we may collect via the Application Site depends on the content and materials you use, and includes:

 

Personal Data

For purposes of this Privacy Policy, the term “personal data” shall mean demographic and other personally identifiable information (such as your name and email address) that you voluntarily give to us when choosing to participate in various activities related to the Application Site, such as registering a dog or submitting an entry. The personal data you provide will vary based upon the context, and we will not collect your personal data unless you make it available. You are not required to provide personal data at any time while visiting the Application Site; however, you may be required to provide personal data to use certain services and activities available through the Application Site. Please be advised that all personal data you disclose in your profile and for your registered dogs and entries, including posted YouTube search videos, are accessible to Cyber Scent Work officers and Review Officials. This data is not accessible to other users through the Application Site or us, unless stated otherwise in this Privacy Policy. Do not provide personal information about others (including by connecting your work email address to our Application Site) unless you are authorized or required to do so by applicable law or contract. Before supplying personal data about others, you, and the person about whom you supply the personal data must review and consent to the Terms and Conditions and Privacy Policy of the Application Site. By submitting any personal data about others, you represent and warrant that you are authorized to do so, that you have made the Terms and Conditions and Privacy Policy available to the person about whom you supply the personal data, and that you have obtained that person's written consent to our Terms and Conditions and Privacy Policy. You agree to indemnify, defend and hold harmless CSW, our parents, subsidiaries, officers, directors, employees, and agents for any failure by you to comply with this paragraph.

 

You may also provide us with special categories of personal data under the GDPR (also known as sensitive data) about yourself and/or third parties, such as health information. When you provide such information, we will seek your explicit consent unless it is being published in relation to the various activities of the Application Site, such as creating an account, registering your dog, or submitting an entry.

 

If you provide “personal data” to the Application Site, you acknowledge and agree that such personal data may be transferred from your current location to the offices and servers of CSW and the authorized third parties referred to herein located in the United States.

 

Derivative Data

Information our servers automatically collect when you access the Application Site, such as your native actions that are integral to the Application Site, including logging in, registering a dog, and submitting an entry, as well as other interactions with the Application Site and/or other users, such as sending a message to Cyber Scent Work through the Application Site itself, via server log files. This information is collected passively using various technologies and may include the type of internet browser or mobile device you use, any website from which you have come to the Application Site, your operating system, and may also include location data through an IP address that identifies the city and state where you logged into the Application Site or your precise geo-location if you have permitted your device to provide that information to us. CSW may store such information itself or such information may be included in databases owned and maintained by CSW affiliates, agents, or service providers.

 

Financial Data

Financial information, such as data related to your payment method (e.g., valid credit card number, card brand, expiration date) that we may collect when you purchase, order, return, exchange, or request information about our services from the Application Site. We only store that a successful payment was made, the total amount charged and the method of payment (PayPal or Stripe). Otherwise, all financial information is stored by our payment processor, PayPal or Stripe, and you are encouraged to review their privacy policy and contact them directly for responses to your questions.

 

Aggregated Data

In an ongoing effort to better understand and serve the users of the Application Site, CSW often conducts research on its customer demographics, interests and behavior based on information we collect. We may de-identify and/or aggregate the information collected through the Application Site for research purposes or any other purposes, and we may share this data with our affiliates, agents, or business partners.

 

Registered Information

To access information on the Application Site and use our services, a user may be required to register with CSW. During registration, a user is required to give certain information (such as name and email address).   3. Fulfill and manage purchases, orders, payments, and other transactions related to the Application Site.

UNSOLICITATED INFORMATION

Please be advised that some information you provide may be publicly accessible, such as information posted in forums or comment sections. We may also collect information through customer support communications, your communication to us of ideas for new products or modifications to existing products, and other unsolicited submissions (collectively, with publicly-accessible information, “Unsolicited Information”). By sending us Unsolicited Information, you (a) agree that we are under no obligation of confidentiality, express or implied, with respect to the Unsolicited Information, (b) acknowledge that we may have something similar to the Unsolicited Information already under consideration or in development, (c) grant us an irrevocable, non-exclusive, royalty-free, perpetual, universe wide license to use, modify, prepare derivative works, publish, distribute and sublicense the Unsolicited Information, and (d) irrevocably waive, and cause to be waived, against CSW and its users any claims and assertions of any moral rights contained in such Unsolicited Information. This Unsolicited Information section shall survive any termination of your account or the Application Site. This Privacy Policy otherwise does not apply to any information collected by CSW other than information collected through the Application Site.

 

TRACKING TECHNOLOGIES

 

Cookies and Web Beacons

We may use cookies, web beacons, tracking pixels, and other tracking technologies on the Application Site to help customize the Application Site and improve your experience by collecting information about your access and use of the Application Site. Please visit the privacy policy of the relevant social media platform to find out more information about your rights and choices.  Additionally, once you have used these links to access the third-party social media platform or third-party advertisements and external services, you leave the Application Site, any information you provide to these third parties is not covered by this Privacy Policy, and we cannot guarantee the safety and privacy of your information. Before visiting and providing any information to any third-party websites, you should inform yourself of the privacy policies and practices (if any) of the third party responsible for that website, and should take those steps necessary to, in your discretion, protect the privacy of your information. We are not responsible for the content or privacy and security practices and policies of any third parties, including other sites, services or applications that may be linked to or from the Application Site.

 

SECURITY OF YOUR INFORMATION

We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal information.

 

POLICY FOR CHILDREN

CONTROLS FOR DO-NOT-TRACK FEATURES

CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below, and we will respond within 30 days as required by law.


If you are under 18 years of age, reside in California, and have a registered account with the Application Site, you have the right to request removal of unwanted data that you publicly post on the Application Site. To request removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Application Site, but please be aware that the data may not be completely or comprehensively removed from our systems.
